For most people the arrival of a new baby is a happy and exciting time, as you’ve probably seen on shows such as One Born Every Minute and The Midwives. Sadly, for a few, adverse events before, during or after birth can have devastating consequences.
Those consequences may include harm to the Mother or to the baby. Many adverse events can have life-changing effects for Mother or for baby, often both, just at the time when you need the fewest problems possible and want to focus on bonding with your little one.
It is widely acknowledged that many hospitals are over-stretched and under-resourced, and this is often one of the key factors seen in cases being investigated for clinical negligence.
Not all injuries will have been caused by negligence. If a claim for damages is to succeed, it will need to be proven that the care given was substandard and that the outcome would probably have been different with competent care.
Martin Hood, Associate Director in the Clinical Negligence department at Jackson Lees, states:
“Although the government has made clinical negligence claims more difficult for affected people to pursue since April of this year, in some limited circumstances (children affected by brain injuries acquired around the time of birth) Legal Aid may still be available. For others, there are different ways of funding your case and we’ll talk through all the options with you. We aim to make sure that, if you have a case to bring, your finances shouldn’t be a barrier to bringing it.
Cases involving injuries during childbirth are often complex claims to investigate and so they need specialist expertise to be done properly. We are one of the few specialist Clinical Negligence firms in the North West and are based on the Wirral. They have acted in many cases where damages have exceeded £1 million, and are handling many more of similar value. A national award was given for work on their biggest-ever case in which they obtained damages of £5.62 million. Not all of their cases are worth as much as that but every client matters to them just as much as the next.
Many clients tell us that deciding to start a Clinical Negligence claim is a scary process. You’ve probably never done anything like it in your life, and we hope you never have to again. We will do our very best to take the “fear” out of bringing a claim, and we will make sure that you understand what is going on, and why. We have both male and female lawyers so you always feel comfortable with the person you’re dealing with.”
