What is Cosmetic Surgery Negligence?

There are two primary types of cosmetic surgery claims, and our solicitors have used their substantial Medical Negligence expertise to achieve success in a range of cases.

Every cosmetic surgery procedure comes with a degree of risk, and it is your surgeon’s duty to ensure you have understood and accepted this. You should be kept fully informed of the specific risks associated with your operation and sign a written agreement indicating you are happy for the work to go ahead.

If you do not receive this information, this may be classed as cosmetic surgery negligence.

Equally, if the results of your operation fall below the standards reasonably expected of a medical expert, you may be able to make a claim. Case Study

We obtained damages for a client who had undergone breast augmentation surgery on a private basis. The surgery was performed after the client had had her first child, but before she had a second child. The client stated that she had queried whether she should delay such surgery until after her family had been completed, but was advised that this was not necessary.

Unfortunately, during her subsequent pregnancy, one of the implants became more visible, and she developed pain in her arms and shoulders. She was subsequently advised that the implant had moved, and that there was fluid surrounding the tissue. She was told that this could have been a result of the pregnancy, and the consequent changes to her breasts.

It was argued that the treatment provided was negligent, and it was alleged that the Defendant should have advised the Claimant that she should postpone the surgery until her family had been completed. This was denied by the Defendant, who denied knowing that the client was actively trying to expand her family.

Following lengthy negotiations, and the issue of court proceedings, the matter was eventually settled for £10,000 without the need to proceed to Trial.
