It was announced in November 2017 that, after 17 years of marriage, Davina McCall and Matthew Robertson decided to go their separate ways. With three kids, their main priority was to ensure their children felt loved and supported during this time. However it was revealed more recently that Davina will reportedly hand £1million to her soon to be ex on top of the £1.5 million he would get for half of the family house in her bid for a ‘clean break’ and quicker divorce.
But is it possible to simply pay your soon to be ex-partner a lump sum and call it a day? Tom Fisher, Family Law Solicitor at Jackson Lees, says:
“It is not unheard of for parties to reach a financial agreement between themselves without the necessity of negotiations via solicitors.
In theory a financial agreement can be anything that the parties have agreed between themselves however without full disclosure from both parties of all their financial assets and liabilities, it would be impossible for a legal representatives and the Court to confirm whether this was a fair settlement for the parties.
If the parties do not wish to enter into a financial disclosure to confirm whether their agreement is fair and reasonable then it would be likely that the Court would insist on a short hearing to confirm that the parties know what they are entering into and ensure that they are not being coerced into doing so.
If however one party wished to seek advice from a legal representative to determine whether their proposed settlement is fair and reasonable, full disclosure of all assets would have to be provided by both parties in order for this to be determined. In short, a lot more is going on behind the scenes then people think!”
