It's Good Divorce Week! Good Divorce Week is a campaign we at Broudie Jackson Canter fully endorse and support; it focuses on highlighting how those involved in a relationship breakdown can ensure their children's needs are put first. The campaign is orchestrated by Resolution, an organisation of family lawyers committed to non-confrontational divorce, separation and other family problems associated with the difficulties of child arrangements.
The campaign falls on the week when MP's are attending a parliamentary briefing session (28th November), hosted by Resolution. The aim of the session is is to raise awareness of how introducing 'no fault divorce' to the process will decrease the conflict associated with divorce, reducing the inevitable detrimental and emotional harm to children when a relationship breaks down.
The issue of no-fault divorce has received heightened attention following the widely reported case of Owens v Owens in July this year. In this case the husband successfully defended his wife's petition for divorce, that was based on unreasonable behaviour, meaning that despite the marriage being over and the couple living separately, the parties had to remain married before starting the divorce process again. Couples should not have to state their reasoning behind separating, complying with criteria written out by the court, as this encourages a toxic end to a separation.
