As of January 3rd 2019, parents with a child born through surrogacy can apply for a parental order in the UK to become their child's legal parent.
This change will not only affect those who are already a single parent through surrogacy, but also those who have struggled to become a parent because of the legal difficulties involved with doing so.
Head of Family Law at Broudie Jackson Canter, Haley Farrell, said:
This is very welcome news for those single parents who have had a child through surrogacy or are considering surrogacy to enable them to have a child and should end a lot of uncertainty.
It is great that the law is positively changing to recognise and assist modern families!
I am a single parent who already has a child through surrogacy, what should I do?
It is important that, if you already have a child born through surrogacy, you are aware of the time in which you can apply for a parental order. There is now a six month period in which you can apply, the deadline being 2nd July 2019. Though you may be able to apply after this date, we encourage you to do so beforehand as the application process is likely to become more complex.
We have a team of experienced, specialist family lawyers who would be delighted to help you with your application. If you would like to speak to one of our lawyers, please message us your enquiry or request a callback at your convenience
