What is a medical negligence claim?

All healthcare professionals have a duty to care for patients to an accepted medical standard. When the standard is not met and an individual suffers injury as a result, that person would have a legal right to make a claim for compensation.

This sort of claim can be brought against any medical professional including doctors, nurses and GPs, whether they work in the public or private sector.

An individual may bring a claim as a result of an injury to themselves or may bring a claim on behalf of a child or a person who is unable to bring a claim for themselves; or a relative who has passed away.

Who pays for the case?

We often deal with cases on a Conditional Fee Agreement (CFA). This means that we won’t charge you for your case if your claim is unsuccessful and allows us to investigate a claim without having to pass the cost onto you. As these cases are risky and we don’t get paid if they fail, we would charge a success fee which is capped to 25% of past losses and 25% of the compensation for the injury itself (below).

In a small number of cases involving brain injury at birth, an individual can fund their case with a form of government funding called Legal Aid – this is based on the injured person’s financial circumstances, not those of their parents or the person bringing the claim on their behalf.

What can you claim compensation for?

You basically recover money for any injury or other losses which you have suffered as a result of the negligence which includes:

  • Pain, suffering and loss of amenity (not being able to enjoy your usual lifestyle anymore)
  • The injury itself
  • Past and future lost earnings
  • Lost pension entitlement
  • The costs associated with care even if you didn’t pay for it (such as care given by a family member or friend as you can claim for this on their behalf
  • Past and future costs involved in DIY and other household activities that can no longer be undertaken as a result of the injury
  • Any technical equipment or home adaptations that may be required as a result of the injury
  • The costs of any further medical treatment
