It has been reported that many people don’t know their net worth and don’t know how to calculate what they have financially.  As a result, often when a couple comes to a divorce and they feel that don’t actually have any assets, they will ask if they do need a Financial Consent Order. The feeling might be, “why do I need that when we are not splitting anything and we don’t have any money?"

The Financial Consent Order is a crucial part of divorce, even when the separated parties don’t have finances to divide. It ensures that you are financially cut from your ex-spouse.

Imagine that you have got divorced but did not want to get a Financial Consent Order.  You go on your way and start enjoying your new life.  Then one day, you win big and can’t wait to enjoy the reward, but you have not cut your financial ties with your ex-spouse because at the time you didn’t feel it was necessary to get a Financial Consent Order.

How would you feel if your ex-spouse was then looking for a share of your big winnings?

What if your ex-partner, who you have separated from for a few years, had fallen behind on the mortgage or has “matrimonial” debts that have not been cleared?

What if your ex-partner failed to implement the agreement that you had both reached and is now refusing to communicate with you?

What would you do?

Many people feel that they do not require a Financial Consent Order because they do not have any assets with their spouse, but the truth is that without one, you will remain financial attached to your ex-spouse.

Whether it’s one year, two years or 10 years later, if you come into some money; through the lottery, inheritance or simply your own hard work, if you do not have a Clean Break Order, your ex-spouse may be entitled to make their claim against your fortune.

So protect yourself now.

If you have reached an agreement but your ex-partner is refusing to cooperate, then we can assist with enforcing the agreement and ensuring that the order is implemented in full.

Whether you have financial assets or not, getting a Financial Consent Order to sever your financial ties with your ex-spouse is very important.
