Property Joint Ownership Disputes Law
Disputes over the Ownership of Property are common. Joint Owners often disagree over how much of the property each owns and how much of the proceeds of sale each are entitled to. Further someone may claim they are entitled to a share in a property even though they are not actually registered as an owner.
Another frequent Dispute is encountered where one Joint Owner wants to sell and the other Joint Owner does not want to.
Disputes between unmarried couples are dealt with by our Family Department. However, non-family related Disputes are also common and can, for example, arise when friends or colleagues have invested money in property with the intention of developing it and selling it on.
The best way to avoid future Disputes is to enter into a deed of trust at the outset which sets out what each owner’s beneficial interest is intended to be.
